Successor Trustee Provisions

What is it?

Successor trustee provisions specify who will manage the trust if the original trustee can no longer serve due to death, incapacity, or resignation. This creates a clear line of succession to ensure uninterrupted trust administration.

Why is it important?

Without clear successor trustee provisions, your trust could end up in court if something happens to the trustee. By naming one or more successors, you ensure continuity and avoid the expense and delay of court proceedings to appoint a replacement.

Example Language

If the initial Trustee fails or ceases to serve, [Name] shall serve as successor Trustee. If [Name] fails or ceases to serve, [Name] shall serve as successor Trustee.
