Trustee Powers
What is it?
This section grants specific powers to the trustee to manage trust assets effectively. This includes powers to buy, sell, and manage investments, real estate, and other assets.
Why is it important?
Broad trustee powers allow for efficient trust administration without requiring court approval for routine transactions. Without adequate powers, trustees may be unable to properly manage or protect trust assets.
Example Language
The Trustee shall have all powers granted by law, plus the power to: invest and reinvest; buy, sell, lease, or mortgage property; borrow money; employ professionals; and make distributions.
