Per Stirpes Distribution

What is it?

Per stirpes (Latin for "by the branch") is a distribution method ensuring each family branch receives an equal share. If a beneficiary dies before receiving their inheritance, their share passes to their descendants rather than being redistributed to other beneficiaries. This preserves bloodline inheritance down each family branch.

Why is it important?

Per stirpes ensures your grandchildren inherit their deceased parent's share rather than being cut out entirely. For example, if you have three children and one dies, that child's portion goes to their children (your grandchildren)—not to your two surviving children. This keeps inheritance flowing down bloodlines rather than across to siblings.

Example Language

Upon the Grantor's death, the Trust Estate shall be distributed to the Grantor's then-living descendants, per stirpes. If any beneficiary fails to survive the Grantor, such beneficiary's share shall pass to such beneficiary's then-living descendants, per stirpes; if none, to the Grantor's other descendants, per stirpes.
